Diante do papel que o Judiciário vem desempenhando na resolução de questões de grande relevância política e social, a presente pesquisa volta-se à compreensão da decisão judicial em casos moralmente sensíveis. Investiga, então, se tais casos, envoltos em discussões referentes aos valores basilares à sociedade, mobilizariam, também, argumentos de conteúdo valorativo. E, com vistas a identificar e analisar tais argumentos, emprega-se, como referencial teórico, a Teoria das Fundações Morais, produzida no terreno da psicologia moral, à leitura dos votos proferidos até o momento no bojo do Recurso Extraordinário 635.659/SP. O caso, no qual se discute a descriminalização do porte de drogas para consumo pessoal, objeto de regulação pelo artigo 28 da Lei de Drogas (Lei nº 11.343/06), é então analisado com vistas a se distinguir referências ao domínio da moralidade, no que diz respeito às fundações morais estabelecidas pelo modelo: cuidado (care/harm), justiça (fairness/cheating), lealdade (loyalty/betrayl), respeito à autoridade (authority/subversion), pureza (purity/degradation) e liberdade (liberty/oppression). Concluiu-se pela identificação, para além da referência aos materiais jurídicos, de argumentos de eficiência acerca da política pública de combate às drogas e argumentos que expressariam juízos valorativos, mormente ligados à perspectiva individualista.

Given the role that the Judiciary has been performing in issues of great political and social relevance, this dissertation aims to understand decision-making in morally sensitive cases. Therefore, it investigates if such cases, decided in a context of discussions around basic values to society, also mobilize arguments with valued content. In order to identify and analyze these arguments, Moral Foundations Theory (MFT), a model developed from moral psychology, is used as a theoretical framework to read the opinions stated so far by the Brazilian Supreme Courts Justices in the Recurso Extraordinário 635.659/SP. The case is about the decriminalization of drug possession for personal use, which is regulated by the article 28 of the Drug Law (Lei nº 11.343/2006), and it is here investigated owing to distinguish references to the moral domain with regard to the moral foundations established by MFT: care, fairness, loyalty, authority, purity and liberty. The research concludes that it is possible the identification of arguments with valued content, especially linked to an individualist perspective.
