O objetivo central deste trabalho é fornecer recomendações às pessoas integrantes do sistema de justiça para tratamento de demandas judiciais envolvendo violência obstétrica, de modo a garantir a máxima efetivação dos direitos humanos das mulheres. Para tanto, a metodologia adotada foi a dogmática jurídica localizada, com revisão bibliográfica sobre violência obstétrica, acesso à justiça e dever de reparação. A partir dos contornos teóricos e normativos do dever de reparação, foi possível elaborar recomendações a cada uma das pessoas envolvidas em uma demanda judicial sobre violência obstétrica. Todas as recomendações perpassam pela necessidade de adoção de uma perspectiva de gênero por parte do sistema de justiça, de modo a possibilitar o efetivo acesso à justiça por parte das mulheres e a obtenção de reparação para os casos de violação de seus direitos humanos. A perspectiva de gênero envolve, entre outras coisas, a adoção de uma abordagem interseccional para tornar visível outros eixos de subordinação que podem refletir na vulnerabilidade das mulheres, o que também deve incidir nas medidas de reparação atribuídas.

The main objective of this work is to provide recommendations to the people who are part of the justice system to deal with lawsuits involving obstetric violence, in order to ensure maximum realization of women's human rights. To do so, the methodology adopted was located legal dogmatic, with bibliographical review on obstetric violence, access to justice and duty to repair. From the theoretical and normative contours of the duty of reparation, it was possible to elaborate recommendations to each one of the people involved in a judicial demand on obstetric violence. All recommendations are based on the need to adopt a gender perspective in the justice system, so as to enable women to effectively access justice and obtain redress for cases of human rights violations. The gender perspective involves, inter alia, the adoption of an intersectional approach to make visible other axes of subordination that may reflect on the vulnerability of women, which should also focus on the remedial measures assigned.
