Com o fim da compulsoriedade da contribuição sindical dado pela Lei nº 13.467/2017, conhecida como Reforma Trabalhista, os trabalhadores não filiados, assim como os contribuintes, beneficiam-se da conquista negocial, sem a obrigação de financiar o sindicato da categoria. Diante disso, esta dissertação tem por objetivo geral analisar se o fim da compulsoriedade da contribuição sindical possibilita a restrição do poder negocial no Brasil. Para tanto, por meio do método de pesquisa dedutivo e técnicas de pesquisa bibliográfica, documental e jurisprudencial, procura-se compreender as principais prerrogativas sindicais no país, o fim da compulsoriedade da contribuição sindical, bem como discutir o fim da compulsoriedade da contribuição sindical e a eficácia subjetiva da negociação coletiva. Ao final, conclui-se pela possibilidade de restrição do poder negocial no contexto pós-Reforma Trabalhista, considerando que a negociação coletiva continua produzindo, como regra, eficácia geral, podendo, excepcionalmente, ser limitada.

With the end of the compulsory union contribution given by Law No. 13,467/2017, known as Labor Reform, non-affiliated workers, as well as the contributors, benefit from the negotiation, without the obligation to finance the union of the category. In view of this, this dissertation aims to analyze if the end of the compulsory union contribution makes it possible to restrict the bargaining power in Brazil. In order to do so, it is sought to understand the main trade union prerogatives in the country, the end of compulsory union contributions, as well as to discuss the end of the compulsory contribution, through the method of deductive research and bibliographic, documentary and jurisprudential, the subjective efficacy of collective bargaining. In the end, it is concluded that there is a possibility of restricting bargaining power in the post-Labor Reform context, considering that collective bargaining continues to produce, as a rule, general efficacy, and may exceptionally be limited.
