Partindo da visão ambiental-constitucionalista denominada de antropocêntrica jurídica ecológica analisou-se a harmonia o bloco normativo sobre resíduos sólidos, no Estado de São Paulo, que versam sobre a gestão adequada de resíduos sólidos. Neste intuito, fora sistematizado a Política Nacional de Resíduos Sólidos (Lei n. 12.305/2010) com a Política Estadual dos Resíduos Sólidos do Estado de São Paulo (Lei Estadual n. 12.300/2006). O pressuposto principal do estudo é de que o bloco normativo investigado não alcança a gestão adequada de resíduos sólidos, cujo objetivo geral é de reduzir as fontes geradoras de resíduos sólidos e, consequentemente, reduzir o volume de rejeitos encaminhados à disposição final, bem como, reduzir a periculosidade dos resíduos sólidos gerados. Nesse sentido, a pesquisa pauta-se na investigação de duas hipóteses: se as políticas públicas de resíduos sólidos não alcançam os seus objetivos pela assimetria entre a norma Estadual com a norma Federal ou se não os alcançam por reflexos de ações governamentais insuficientes na gestão dos resíduos sólidos. Investigando, neste aspecto, qual o caminho e os atos que o administrador público poderia seguir. As hipóteses levantadas foram averiguadas utilizando-se do método científico ensinado por Marconi e Lakatos. Analisou-se o tema partindo do método dedutivo em combinação ao método indutivo para alcançar à conclusão. Em outras palavras, o método dedutivo foi empregado na sistematização da Política Pública Federal com a Política Pública Estadual, do Estado de São Paulo. E, empregou-se o método indutivo na apreciação dos instrumentos que conduzem a gestão dos resíduos sólidos. Para isto, utilizou-se de documentação indireta, tais como: doutrinas, teses, artigos científicos, dissertações, relatórios federais e estaduais entre outros. Ao final, constatou-se que a Política Estadual de Resíduos Sólidos, do Estado de São Paulo, apesar de anterior, está (em grande parte) em harmonia com a Legislação Federal - PNRS. Todavia, quanto à atividade de planejamento administrativo, que nortearia a execução das políticas públicas como um todo no país, em todas as esferas e para todos os sujeitos responsáveis pelo cumprimento das normas, não alcançam resultados satisfatórios. O estudo destaca que a ausência do principal plano, o Federal, poderia resultar em um plano Estadual inefetivo, no Estado de São Paulo. Portanto, levantou-se a hipótese de que os planos de gestão Municipais são/estão ineficientes e/ou inadequados em decorrência desta rachadura no sistema de planejamento administrativo, podendo ocasionar, consequentemente, planos de gerenciamento ineficientes e/ou inadequados.

Based on the environmental-constitutionalist view called ecological legal anthropocentric, the harmony of the normative block on solid waste in the State of São Paulo was analyzed, which relates to the proper management of solid waste. To this end, the National Solid Waste Policy (Law n. 12.305/2010) was systematized with the State Policy on Solid Waste of the State of São Paulo (State Law n. 12.300/2006). The main assumption of the study is that the regulatory block under investigation does not achieve adequate solid waste management, the overall objective of which is to reduce the sources of solid waste and reduce the final disposal of waste and reduce the risk of solid waste generated. For that matter, the research is based on the investigation of two hypotheses: whether public policies on solid waste does not achieve their objectives due to the asymmetry between the State norm and the Federal norm or are not achieved by reflections of insufficient government actions in the management of solid waste. Investigating, in this aspect, which path and acts the public administrator could follow. The hypotheses raised were investigated using the scientific method taught by Marconi and Lakatos. The issue was analyzed using the deductive method combined with the inductive method to reach the conclusion. In other words, the deductive method was used in the systematization of the Federal Public Policy with the State Public Policy, of the State of São Paulo. In addition, the inductive method was used to assess the instruments for managing solid waste. For this, indirect documentation was used, such as: doctrines, theses, scientific articles, dissertations, federal and state reports among others. At the end, the State Policy on Solid Waste of the State of São Paulo was found, although previous, it is (largely) in harmony with the Federal Legislation - PNRS. However, as for administrative planning activity, which would guide the implementation of public policies as a whole country, in all spheres and for all subjects responsible for compliance with the norms, does not achieve satisfactory results. The study highlights that the absence of the main plan, the Federal, resulted in an ineffective state plan, in the State of São Paulo. Therefore, the hypothesis was raised that the municipal management plans are inefficient and/or inadequate as a result of this crack in the administrative planning system, could be resulting, consequently, in inefficient and/or inappropriate management plans.
