O presente trabalho visa analisar as estratégias jurídicas utilizadas pelo do setor empresarial no campo do poder na condução das políticas urbanas no município de São Paulo. Para isso, apresenta-se uma introdução sobre os conflitos urbanos, que operam em uma disjuntiva que tem por um lado a busca pela efetivação de direitos; e, por outro, a busca por lucro a partir do espaço urbano. Entender este conflito passa por compreender as estratégias dos agentes dominantes na condução desta política. O trabalho divide-se em duas partes: na primeira, realiza-se uma análise sobre o papel do Direito e do Estado na definição dessas políticas urbanas; na segunda, apresentam estratégias utilizadas para conduzir as normas urbanísticas de acordo com os interesses dos agentes dominantes. A perspectiva adotada vale-se de diversos conceitos desenvolvidos a partir dos estudos de Pierre Bourdieu, que vão se entrelaçando com noções da Filosofia e Teoria Geral do Direito, da Teoria do Estado e do Direito Urbanístico. Na primeira parte da dissertação, apresenta- se a discussão teórica referente ao tema; já na segunda, são apresentados exemplos práticos sobre como se dá o processo de costura normativa ("coser") destes interesses empresariais e de estratégias temporais nas alterações legais (o "cozer") utilizadas por esses agentes. Ao fim é apresentada uma conclusão explicitando que esse conjunto de iniciativas configura uma estratégia forte e perene, mas não imutável, apresentando possibilidades para alteração de correlação de forças no campo do poder e indicando agendas de pesquisas sobre o tema.

The present work aims to analyze the legal strategies used by the business sector in the field of power in the conduct of urban policies in the city of São Paulo. For that, an introduction to urban conflicts is presented, operating in a disjunctive that on the one hand, the search for the realization of rights; and, on the other hand, the search for profit from the urban space. Understanding this conflict involves understanding the strategies of the agentes dominant in the conduct of this policy. The work is divided into two parts: in the first, an analysis is carried out on the role of Law and the State in the definition of these policies urban; in the second, they present strategies used to guide urban norms according to the interests of the dominant agents. The adopted perspective is based on several concepts developed from the studies of Pierre Bourdieu, which will be intertwining with notions of Philosophy and General Theory of Law, State Theory and Urban Law. In the first part of the dissertation, the theoretical discussion is presented related to the theme; in the second, practical examples are presented on how the normative sewing process (sewing) of these business interests and strategies temporal changes in the legal changes (the baking) used by these agents. At the end it is presented a conclusion explaining that this set of initiatives configures a strong and perennial, but not immutable, presenting possibilities for changing the correlation of forces in the field of power and indicating research agendas on the subject.
