A presente dissertação de mestrado aborda a importância das circunstâncias fáticas do caso concreto na delimitação da ratio decidendi de um precedente. O principal objetivo da pesquisa é identificar se o Superior Tribunal de Justiça, ao editar suas súmulas, tem se atentado às circunstâncias fáticas de seus precedentes, tal qual estabelece o § 2º, do art. 926 do Código de Processo Civil. Os dois primeiros capítulos consistem em uma revisão bibliográfica. No primeiro, utilizando-se dos métodos histórico, comparativo e dedutivo, são expostas as origens históricas das duas grandes famílias do direito ocidental Civil Law e Common Law. No segundo, também se utilizando do método dedutivo, analisa-se as peculiaridades do sistema de precedentes brasileiro introduzido pelo novo Código de Processo Civil (Lei n.º 13.105/2015). Por fim, o terceiro capítulo consiste em uma pesquisa empírica em que, através do método indutivo, é feita a leitura do inteiro teor dos acórdãos do Superior Tribunal de Justiça que serviram como precedentes para a edição de suas súmulas, buscando com isso constatar se o enunciado abrangeu as circunstâncias fáticas dos casos concretos. Ao final, verifica-se que o Superior Tribunal de Justiça não tem observado adequadamente o comando legal, necessitando repensar a forma como redige suas súmulas para garantir a coerência e integridade do seu sistema de precedentes.

The present master's thesis addresses the importance of the factual circumstances of the concrete case in delimiting the ratio decidendi of a precedent. The main objective of the research is to identify if the Superior Court of Justice, when editing its statements, has been paying attention to the factual circumstances of its precedents, as established in § 2, of art. 926 of the Civil Procedure Code. The first two chapters consist of a bibliographic review. In the first one, using the historical, comparative and deductive methods, the historical origins of the two great families of Western law - Civil Law and Common Law - are exposed. In the second one, also using the deductive method, the peculiarities of the Brazilian precedent system introduced by the new Civil Procedure Code (Law No. 13.105 / 2015) are analyzed. Finally, the third chapter consists of an empirical research in which, through the inductive method, the entire content of the Superior Court of Justice judgments, that served as precedents for the edition of its statements is read, thus seeking to determine if the assertion covered the factual circumstances of the concrete cases. After all, it turns out that the Superior Court of Justice has not properly observed the legal command, needing to rethink the way its statements are written to ensure consistency and integrity of its precedent system.
