A reforma trabalhista perpetrada pela Lei n° 13.467/2017 incorporou o instituto da jurisdição voluntária ao processo do trabalho (Capítulo III-A, artigos 855-B a 855-E, da CLT). Assim teria feito com o intuito de desafogar a justiça especializada por meio do estímulo à transação extrajudicial. Desta feita, o que se pretendeu foi uma análise do acesso à Justiça do Trabalho pós-reforma trabalhista e da alternativa que ela criou. Nessa medida, questionou-se: a) a qualidade dos acordos extrajudiciais que estão sendo submetidos ao crivo do Judiciário Trabalhista, na perspectiva do controle judicial e; b) a necessidade de estipulação de um rol de direitos que não pode ser objeto de tais acordos. Em busca de respostas, primeiramente, foi feito um apanhado histórico do processo de judicialização e consecutiva desjudicialização dos conflitos individuais do trabalho no Brasil, a fim de se contextualizar a recente alteração legislativa que introduziu o instituto da jurisdição voluntária no processo do trabalho com essa última finalidade. Na sequência, buscou-se identificar o núcleo de direitos do trabalho que, dada a sua indisponibilidade, não pode ser objeto de transação. Por fim, já identificado o núcleo de direitos que não pode ser objeto de transação, foi analisada a qualidade dos acordos extrajudiciais que vêm sendo submetidos à homologação judicial e a necessidade de restrição do seu objeto à determinada classe de direitos. Isto, sob a ótica do controle judicial e mediante análise documental.

The labor reform perpetrated by Law nº 13.467/2017 incorporated the institute of voluntary jurisdiction into the labor process (Chapter III-A, articles 855-B to 855-E, of the CLT Consolidation of Brazilian Labor Laws). This alterations would have been done with the aim of relieving specialized justice by encouraging extrajudicial transactions. This time, what was intended was an analysis of access to Labor Justice after labor reform and the alternative it created. To that extent, it was questioned: a) the quality of the extrajudicial agreements that are being submitted to the Labor Judiciary, under the perspective of judicial control and; b) the need to stipulate a list of rights that cannot be the object of such agreements. In search of answers, first, a historical overview of the judicialization process and consecutive dejudicialization of individual labor conflicts in Brazil was made, in order to contextualize the recent legislative change that introduced the institute of voluntary jurisdiction in the process of working with the latter goal. Then, we sought to identify the core of labor rights that, given their unavailability, cannot be the object of a transaction. Finally, having identified the core of rights that cannot be the object of a transaction, the quality of the extrajudicial agreements that have been submitted to judicial ratification and the need to restrict their object to a certain class of rights has been analyzed. This, from the perspective of judicial control and through documentary analysis.
