A presente dissertação aborda a problemática questão da responsabilidade civil do Estado Legislador, especificamente na hipótese de leis de efeitos concretos. A hipótese é que o Estado pode ser responsabilizado e que o caráter ilícito da lei inconstitucional não é um elemento decisivo; o que importa é o resultado danoso. Por essa razão, a lei de efeitos concretos ganha especial importância, visto que o enfoque se circunscreve aos efeitos irradiados pelo ato legislativo (resultado) e não ao seu conteúdo. Fixada a possibilidade de responsabilização do Estado e determinado o papel da lei de efeitos concretos nessa simbiose, serão apresentadas, ao final, propostas teóricas sintetizadas de acordo com os estudos desenvolvidos ao longo do presente trabalho.

This dissertation addresses the problematic issue of the civil liability of the Legislating State, specifically in the hypothesis of concrete effects law. The hypothesis is that the State can be held responsible and that the illicit nature of the unconstitutional law is not a decisive element; what matters is the damaging result. For this reason, the concrete effects law gains special importance, since the focus is limited to the effects radiated by the legislative act (result) and not in its content. Once the possibility of State accountability is fixed and the role of the concrete effects law in this symbiosis is determined, theoretical proposals will be made, synthesized according to the studies developed throughout the present work.
