Partindo da análise do discurso de ódio como um fenômeno verificado nas eleições brasileiras de 2018, este trabalho busca investigar as possibilidades de conceptualização dogmática do referido fenômeno no âmbito eleitoral. Para isso, na Parte Um, inicia com a investigação da doutrina constitucional brasileira e americana sobre a liberdade de expressão e suas possibilidades de restrição; passa para uma discussão sobre o discurso de ódio em três níveis metodológicos (deontológico, instrumental e empírico). A Parte Dois trata da aplicação dos resultados obtidos da reflexão sobre o tema para a proposta de conceptualização do discurso de ódio e, em seguida, elabora hipóteses de conformação dogmática do fenômeno em institutos do Direito Eleitoral brasileiro.

Starting from the analysis of hate speech as a phenomenon verified in the Brazilian elections of 2018, this work seeks to investigate the possibilities of dogmatic conceptualization of the referred phenomenon in the electoral scope. In Part One, there is the investigation of Brazilian and American constitutional doctrine on free speech and its possibilities of restriction; it moves on to a discussion of hate speech at three methodological levels (deontological, instrumental and empirical). Part Two deals with the application of the results obtained from the reflection to the proposal to conceptualize hate speech, and then elaborates hypotheses of dogmatic conformation of the phenomenon in Brazilian Electoral Law institutes.
