O objetivo geral do trabalho é analisar como as assimetrias de gênero atravessam as práticas mediadoras realizadas nos CEJUSC e limitam a efetividade da mediação familiar na garantia de acordos equânimes e de acesso à justiça as mulheres. A escolha política e jurídica de incentivo e fortalecimento da mediação nos casos de conflitos familiares enseja a questão que orientou a proposta da presente pesquisa: quais as limitações da mediação familiar para a garantia de acesso à justiça de mulheres no contexto social brasileiro, marcado por assimetrias de gênero e relações desiguais de poder entre homens e mulheres? Em termos metodológicos, este trabalho é uma pesquisa empírica, sob abordagem de cunho qualitativo, com uso de técnicas de observação não participante e orientado por pesquisa bibliográfica baseada em revisão de literatura. A observação realizou-se em três Centros Judiciários de Solução de Conflitos e Cidadania (CEJUSC) do município de São Paulo SP. O trabalho permitiu apreender que, na prática da mediação familiar, por vezes, estão ausentes os standards éticos de neutralidade esperados de mediadores, bem como o princípio da isonomia, o diálogo e o consenso que regem a prática mediatória. Ademais, concluiu-se que a prática do(a) mediador(a) e a própria dinâmica da mediação familiar (re)produzem as assimetrias de gênero, o que, por sua vez, impedem a garantia de acordos equânimes e, de modo amplo, o acesso à justiça das mulheres que buscam a mediação familiar para a solução de seus conflitos.

The general objective of this work is to analyze how gender asymmetries permeate the mediation processes that are developed at the CEJUSC and limit the effectiveness of family mediation in guaranteeing equitable agreements and access to justice for women. The political and legal choice to encourage and strengthen mediation in cases of family conflicts raises the question that guided the proposal of this research: what are the limitations of family mediation to guarantee access to justice for women in the Brazilian social context, marked by gender asymmetries and unequal power relations between men and women? In methodological terms, this work is an empirical research, under a qualitative approach, using non-participant observation techniques and guided by bibliographic research based on literature review. The observation took place in three unities of the Brazilian Judicial Centers for Conflict Resolution and Citizenship (CEJUSC) in the city of São Paulo - SP. The work made it possible to apprehend that, in the practice of family mediation, the ethical standards of neutrality expected from mediators are sometimes absent, as well as the principle of isonomy, the dialogue and the consensus that should govern mediation practice. Furthermore, it was concluded that the practice of the mediator and the dynamics of family mediation itself is capable of (re)produce gender asymmetries, which, in their turn, harm the guarantee of equitable agreements and, in a broad way, the access to justice for women who seek family mediation to resolve their conflicts.
