Neste estudo é abordado o tratamento jurídico-penal conferido à pessoa com transtorno mental e em conflito com a lei, submetida a um processo-crime em curso, avaliada como penalmente inimputável e sujeita a regras peculiares de um sistema de responsabilização criminal especial. O objetivo do estudo consiste na interpretação do artigo 319, inciso VII, do CPP, a partir do método teleológico-sistemático, com o fim de verificar a natureza da internação provisória e sua funcionalidade frente à política antimanicomial consubstanciada na Lei nº 10.216/2001. Empregou-se o método hipotético-dedutivo; a pesquisa é de caráter qualitativo e bibliográfico e considerada como premissa a vedação de aplicação de medidas de segurança preventivas à vista da atual redação do CP e da jurisprudência do STJ. Chegou-se à conclusão que a internação provisória, a despeito de recente alteração no CPP, ainda não atendeu ao fundo ideológico da Lei nº 10.216/2001, devendo ser estimulada a criação de mecanismos que associem os aparelhos da justiça penal com as de atenção psicossocial, como forma de conferir à pessoa com transtorno mental, no decorrer do curso processual, tratamento psiquiátrico como garantia de efetivação do direito humano à saúde mental. A doença mental é abordada neste trabalho apenas sob o ponto de vista jurídico-penal (absolutamente desconsideradas as perspectivas médicas), avaliando-se suas reverberações nessa esfera.

In this study, the penal treatment given to the person with mental disorder and in conflict with the law, subject to an ongoing criminal proceeding, assessed as criminally incomputable and subject to the peculiar rules of a special criminal liability system, will be addressed. The objective of the study is the interpretation of article 319, item VII, of the Criminal Procedure Code, using the teleological-systematic method, in order to verify the nature of provisional hospitalization and its functionality in view of the anti-asylum policy embodied in Law n. 10.216/2001. The hypothetical-deductive method will be used; the research will be qualitative and bibliographic and considered as a premise the prohibition of applying preventive security measures in view of the current wording of the Penal Code and the jurisprudence. It was concluded that provisional hospitalization, despite a recent reform in the CPP, has not yet met the ideological background of Law No. 10.216/2001, and the creation of mechanisms that associate the criminal justice apparatus with those of psychosocial care should be encouraged, as a way of giving the person with mental disorder, during the procedural course, psychiatric treatment as a guarantee of the realization of the human right to mental health. Mental disorder will be approached only from the legal-penal point of view (medical perspectives absolutely disregarded), evaluating its reverberations in this sphere.
