Esta dissertação tem por objetivo analisar a disciplina normativa dos acordos de leniência e dos termos de compromisso de cessação antitruste, com vistas a avaliar a aptidão do nosso ordenamento jurídico para compor satisfatoriamente os vários interesses colidentes quando se trata de fazer atuar os comandos legais em tal seara, a saber, o interesse difuso à transparência da autuação administrativa, o interesse subjetivo de terceiros de acessar o material da leniência para tutela de direitos patrimoniais e o interesse público de preservar a atratividade do programa de leniência do CADE. Para tanto, de início, apresentou-se um panorama das origens, justificativas, objeções e fundamentos da administração pública concertada por ser em tal contexto que nasceram os instrumentos consensuais destacados. Em seguida, foi exposto o resultado do estudo doutrinário sobre o acordo de leniência e do termo de compromisso de cessação de prática anticompetitiva. Então, após breve digressão sobre o princípio da publicidade e da lei de acesso à informação, mostrou-se a dinâmica do sigilo nas várias fases do programa de leniência do CADE. Finalmente, debateu-se dois casos práticos julgados pelo Tribunal Administrativo de Defesa Econômica para ilustrar qual foi o posicionamento do Poder Judiciário e do Ministério Público sobre a extensão do sigilo dos acordos de leniência sob o aspecto da publicidade externa.

This dissertation aims to analyze the normative discipline of leniency agreements and cease and desist agreements, with a view toward assessing the strength of our legal system to satisfactorily compose the various colliding interests when it comes to enforcing legal commands. Namely, these include the diffuse interest in the transparency of public administration, the subjective interest of third parties to acess leniency material for the protection of patrimonial rights and the public interest in preserving the attractiveness of the Administrative Concil for Economic Defense - CADE´s leniency program. First, an overview of the origins, justifications, objections and foundations of the concerted public administration was presented given that this was the context in which the highlighted consensual agreements were established. Then, results of doctrinal studies of leniency agreement and cease and desist agreement were exposed. Then, following a brief digression on the principle of publicity and the law on acess to information, the dynamic of confidentiality was shown in the various phases of CADE´s leniency program. Finally, two practical cases adjudicted by Administrative Court of Economic Defense - TADE were discussed to illustrate what was the position of the Judicary and the Prossecution Service regarding the extension of the confidentiality of leniency agreements in terms of external publicity.
