As marcas da hierarquização e estratificação em virtude do gênero estão presentes em todos os processos da vida social. Naturalizou-se atribuir a cada um dos gêneros direitos, funções, papéis e lugares sociais específicos; a generificação das atribuições atravessa gerações e ainda existem obstáculos para a aceitação das competências fora dos limiares historicamente constituídos. Gênero e moradia são temas estreitamente relacionados na América Latina, assertiva corroborada pelo fato de que os movimentos sociais de moradia têm um número expressivo de mulheres participantes. Nestas ações coletivas o protagonismo feminino é recorrente, entretanto, a outorga desses direitos, além de ser resultado das políticas públicas habitacionais, tem perpassado pela apreciação das cortes jurídicas. A judicialização de demandas para a consolidação dos direitos sociais tem sido cada vez mais frequente, diante disso busca-se compreender como as decisões judiciais sobre moradia tratam as questões de gênero. O direito à moradia, a igualdade de gênero, a inserção em movimentos sociais e o acesso à justiça têm sido temas de um desafio transversal, por isso, o propósito é analisar como o sistema de justiça trata os casos de moradia pleiteados pelos movimentos sociais, tendo como circunscrição de investigação a presença feminina, observando as recomendações do Ministério Público e as decisões finais do Poder Judiciário no Tribunal de Justiça do Estado de São Paulo, comarca da capital, Primeira e Segunda Instâncias, nas demandas que envolvem os movimentos sociais de moradia urbana, entre 2010 e 2020. Os documentos (recomendações e decisões judiciais), como tecnologia de Estado, serão analisados por seu conteúdo, destacando a maneira como as integrantes dos movimentos sociais são descritas e referenciadas, a finalidade do objeto da disputa judicial e a localização espacial dos mesmos. As palavras não são neutras, carregam o sentido político e social; mesmo sendo uma decisão jurídica com linguagem técnica e formal, a escolha dos termos e descritores revelam o sentido sociopolítico da interpretação das normas, por isso, propõe-se ainda analisar a construção argumentativa, principiológica e normativa das decisões. Para isto, como método de pesquisa será realizada a análise documental e de conteúdo das recomendações e decisões judiciais. A hipótese suscitada é que o sistema de justiça está atento a formação dos coletivos de moradia urbana, compostos em sua maioria por mulheres, formulando recomendações e prolatando decisões com equidade, corrigindo por meio do acesso à justiça as desigualdades de gênero; materializando o entendimento das transformações sociais. O tema sob investigação pode ensejar outros estudos e repercutir em outras áreas de pesquisa possibilitando o prolongamento da análise.

The marks of hierarchization and stratification by virtue of gender are present in all processes of social life. It has become natural to assign to each of the genders specific rights, functions, roles and social places; the generification of attributions crosses generations and there are still obstacles to the acceptance of competences outside historically constituted thresholds. Gender and housing are closely related issues in Latin America, a statement corroborated by the fact that social housing movements have a significant number of women participants. In these collective actions, the feminine rotagonism is recurrent, however, the granting of these rights, besides being a result of public housing policies, has passed through the appreciation of the legal courts. The judicialisation of demands for the consolidation of social rights has been increasingly frequent, and in view of this, we seek to understand how judicial decisions on housing address gender issues. The right to housing, gender equality, the insertion in social movements and the access to justice have been themes of a transversal challenge, therefore, the purpose is to analyse how the justice system deals with housing cases claimed by social movements, having as research circumscription the female presence, observing the recommendations of the Public Prosecutor's Office and the final decisions of the Judiciary Power in the Court of Justice of the State of São Paulo, capital district, first and second instance, in claims involving social movements for urban housing, between 2010 and 2020. The documents (recommendations and court decisions), as state technology, will be analysed by their content, highlighting the way in which the members of the social movements are described and referenced, the purpose of the object of the legal dispute and their spatial location. Words are not neutral, they carry a political and social sense; even though the legal decisions use a technical and formal language, the choice of terms and descriptors reveal the sociopolitical meaning of the interpretation of the norms. For this, as a research method it will be performed a documentary and content analysis of the recommendations and court decisions. The hypothesis raised is that the justice system is attentive to the formation of urban housing collectives, composed mostly by women, formulating recommendations and rendering decisions with equity, correcting through access to justice gender inequalities; materializing the understanding of social transformations. The subject under investigation may give rise to other studies and have repercussions in other areas of research, enabling the extension of the analysis.
