O objetivo desta dissertação é analisar como a estrutura do sistema interamericano de direitos humanos pode contribuir para ampliar a proteção do princípio do non-refoulement considerado a pedra angular de proteção dos refugiados e consagrado no artigo 33 da Convenção de 1951, que proíbe a expulsão ou rechaço de um refugiado para o território em que a sua vida ou a sua liberdade seja ameaçada em virtude da sua raça, da sua religião, da sua nacionalidade, do grupo social a que pertence ou das suas opiniões políticas. Busca-se, então, analisar esse princípio em um contexto de evolução da proteção internacional do indivíduo e do desenvolvimento do regime de direitos humanos, que contribuem para uma ordem jurídica global cuja unidade sistêmica básica é o ser humano, e não o Estado. A natureza territorial do princípio do non-refoulement, entretanto, impõe limites a essa ordem, que enfrenta a atuação estatal na tentativa de preservar a sua soberania. Diante disso, este estudo se propõe a entender como os órgãos do sistema interamericano avançam interpretações sobre esse princípio e aumentam a proteção de refugiados, os desafios diante das práticas estatais, relacionadas à segurança e à cooperação, e, por fim, desenvolve um estudo de caso da situação dos refugiados venezuelanos na região, bem como possíveis caminhos para enfrentá-la.

This dissertation aims to analyze how the structure of the Inter-American human rights system can contribute to expanding the protection of the principle of non-refoulement considered the cornerstone of refugee protection and in article 33 of the 1951 Convention, which prohibits the expulsion or return of a refugee to where his life or freedom would be threatened on account of his race, religion, nationality, membership of a particular social group or political opinion. It then seeks to analyze this principle in a context regarding the development of the international protection of individuals and the human rights regime, which contribute to a global legal order whose basic systemic unit is the human being, not the State. The territorial nature of the principle of non-refoulement, however, imposes limits on that order, which faces measures from States attempting to preserve their own sovereignty. Therefore, this study aims to understand how the organs of the Inter-American system are advancing notions related to this principle and increasing refugee protection; what are the challenges in the face of State actions concerning security and cooperation; and, finally, develops a case study on the situation of Venezuelan refugees in the region, as well as possible ways to address it.
