Essa dissertação tem como tema o reconhecimento dos venezuelanos como refugiados pelo governo brasileiro em 2019, através da aplicação da definição ampliada de refugiado baseada na Declaração de Cartagena de 1984, incorporada na legislação brasileira pelo art. 1°, inciso III, da Lei 9.474/97. Trata-se de uma pesquisa qualitativa, um estudo de caso da expansão do regime internacional de refúgio para os venezuelanos, na qual será feita revisão bibliográfica, análise histórica e levantamento de normas internacionais e nacionais, de documentos oficiais, de registros em arquivos e de reportagens de jornais renomados, que serão analisados com base em preposições teóricas pela análise de conteúdo. A perspectiva das relações internacionais utilizada é a construtivista, com ênfase nas contribuições do modelo de análise da expansão do regime internacional para os refugiados do autor Alexander Betts (2013). O autor argumenta que apenas a adesão ao regime internacional para os refugiados e sua internalização ao ordenamento jurídico nacional não correspondem a sua implementação de fato no nível doméstico, que será resultado de um debate interno no qual quanto mais lacunas e imprecisões normativas, maior será a politização das decisões sobre refúgio. Assim, acredita-se que a decisão de reconhecimento dos venezuelanos como refugiados pelo governo brasileiro foi resultado da política nacional, e não de preocupações com o respeito aos direitos humanos dessa nacionalidade.

The theme of this dissertation is the recognition of Venezuelans as refugees by the Brazilian government in 2019, through the application of the expanded definition of refugee based on the 1984 Cartagena Declaration, incorporated into Brazilian law by Article 1, III, of Law 9.474/97. It is qualitative research, a case study of the expansion of the international refugee regime for Venezuelans, in which there will be a bibliographical review, historical analysis and a review of international and national norms, official documents, archival records and reports from renowned newspapers, which will be analyzed based on theoretical prepositions through content analysis. The international relations perspective used is constructivism, with an emphasis on the contributions of Alexander Betts' (2013) model of analysis of the expansion of the international refugee regime. The author argues that only adherence to the international refugee regime and its internalization into the national legal system does not correspond to its de facto implementation at the domestic level, which will be the result of an internal debate in which the more gaps and imprecisions in the rules, the greater the politicization of the decisions on refuge. Thus, it is believed that the decision to recognize Venezuelans as refugees by the Brazilian government was the result of national politics, and not due to concerns about the respect for the human rights regarding this nationality.
