Esta dissertação tem por objetivo analisar qualitativamente como o comportamento geral das organizações criminosas são moldadas pelos incentivos presentes nos mercados ilícitos nos quais atuam. Combinada às estatísticas gerais de crime e aos materiais secundários, a avaliação empírica se constrói com base nas evidências produzidas pelo Sistema de Justiça Criminal a partir de casos judiciais em desfavor de policiais corruptos e criminosos organizados. Baseado nas Teorias Econômicas do Crime Organizado, propõe-se estudar o crime organizado como firma ilícita produtora e reguladora de proteção privada em áreas onde a presença estatal, via suas instituições, é ausente, fraca ou incompleta. Para isso, apresenta-se um estudo de caso sobre a organização criminosa auto intitulada Primeiro Comando da Capital, a fim de analisar descritivamente como seu comportamento geral é moldado pelos mercados ilícitos que atua, nominalmente o tráfico de drogas ilícitas no Estado de São Paulo entre 2011 e 2019, e como promove seu negócio de proteção, para encontrar a demanda de diversas outras firmas ilícitas e indivíduos que atuam na ilegalidade, mas que são incapazes de se auto protegerem dos riscos associados às suas atividades ilegais.

This dissertation aims to analyze qualitatively how criminal organizations' general behavior is shaped by the incentives present in the illicit markets in which they operate. The empirical assessment combines available statistics on crimes and other secondary sources with evidence produced by the criminal justice system based on court cases against corrupt police officers and organized criminals. Based on the Economic Theory of Organized Crime, it suggests studying organized crime as a producer and regulator of private protection in areas where the State presence, via its institutions, is absent, weak, or incomplete. It presents a case study on the criminal organization called Primeiro Comando da Capital, to analyze descriptively how its general behavior is shaped by the illicit markets it operates, namely the illegal drug trafficking and private protection in the State of São Paulo between 2011 and 2019, and how it promotes its protection business to meet the demand of illicit firms and individuals willing to act illegally, but unable to protect themselves from the risks associated with their illegal activities.
