As modificações no panorama internacional, especialmente ao longo destes últimos dois séculos, decorrentes das novas formas de organização social, dos avanços tecnológicos e das mudanças na economia mundial, produziram novos atores que alteraram as bases práticas e teóricas de analisar os fenômenos de guerra. Dentre essas novidades, surgem as Empresas Militares Privadas (EMPs), que representam uma parte da esfera privada da guerra, bem como da violência, até então monopolizada pelos Estados. Essas companhias oferecem um grande escopo de serviços militares, podendo ser contratadas por atores estatais ou não estatais, para operações de combate, manutenção de paz, de segurança de bens e pessoas, entre outros. Na América Latina, em especial na Colômbia, as EMPs operam fornecendo ajuda no combate a cartéis de drogas, treinamento militar, auxílio na defesa de fronteiras, vigilância e resolução de conflitos civis, entre outras atividades. A contratação desse tipo de empresa, porém, pode gerar danos à população civil e, consequentemente, aos Estados em que estão presentes, uma vez que, ao contrário das forças armadas oficiais de um país, elas não possuem a responsabilidade de zelar pela proteção dos indivíduos e são escassos os mecanismos de investigação e punição das violações cometidas por elas. Esta pesquisa pretende analisar os impactos gerados por estes atores internacionais privados não regulamentados sobre civis, evolvidos ou não com o conflito colombiano, e investigar de que maneira os mecanismos de regulamentação e fiscalização da ação das EMPs poderiam contribuir para a diminuição, ou até anulação destes impactos.

Changes in the international scenario, especially over the last two centuries, resulting from new forms of social organization, technological advances and changes in the world economy, have produced new actors that have altered the practical and theoretical bases of analyzing the phenomena of war. Among these novelties, the Private Military Companies (PMCs) appear representing the private sphere of the war, as well as of the violence, until then monopolized by the States. These companies offer a wide range of military services, and may be hired by state or non-state actors, for combat operations, peacekeeping, security of goods and people, among others. In Latin America, especially in Colombia, PMCs operate by providing assistance in combating drug cartels, military training, assistance in border defense, surveillance and resolution of civil conflicts, and other activities. Hiring this type of company, however, can cause damage to the civilian population and, consequently, to the States in which they are acting once, unlike the countrys official armed forces, they are not responsible for ensuring the protection of individuals and there are few mechanisms for investigating and punishing violations committed by them. This research intends to analyze the impacts generated by these unregulated private international actors on civilians, involved or not with the Colombian conflict, and to investigate how the mechanisms of regulation and inspection of the action of the PMCs could contribute to the reduction, or even annulment, of these impacts.
