Esta dissertação apresenta um estudo de caso sobre a Função Social da Propriedade, conforme a Lei 10.257/2001, o chamado Estatuto da Cidade, aplicada a Ilha de Santa Catarina. É importante frisar que a cidade de Florianópolis, capital do estado de Santa Catarina apresenta uma realidade, jurídica e de fato, distinta entre sua porção continental e insular. Esta última compondo o objeto da tese. A ilha tem apresentado significativo crescimento populacional nas últimas décadas, o qual se convencionou chamar de "crescimento urbano desordenado". É comum atribuir este fato à chamada "especulação imobiliária" buscando-se uma relação direta com o capitalismo. Nosso intuito aqui é demonstrar que entre o mercado e o território existe um elemento sempre presente, o estado. Com seu emaranhado de leis e órgãos fiscalizadores, o estado contribui sobremaneira para a situação aparentemente caótica em que se encontra o espaço urbano e rural da ilha.

This dissertation presents a case study on the Social Function of the Property, according to Law 10.257/2001, called Statute of the City, apllied the Island of Santa Catarina. It is important to emphasize that the city of Florianópolis, capital of the state of Santa Catarina, presents a reality, legal and in fact, distinct between its continental and insular portion. This last one composes the object of the thesis. The island has presented a significant population growth in the last few decades, which was established to call disarranged urban growth. It is common to attribute this fact to what is called speculation of immovable property searching a direct relation to the capitalism. Our intention here is to demonstrate that exist an always present element, the state, between market and territory. With its confusion of laws and supervise agencies, the state contributes excessively for the apparently chaotic situation in which is found the urban and rural space of the island.
