O período entre o Massacre do Carandiru, em 1992, e a Lei Antiterror, em 2016, registra dois movimentos antagônicos pelos quais passou a esfera pública referente às disputas em torno dos direitos humanos no sistema punitivo: um primeiro de democratização, iniciado a partir da repercussão do episódio na Casa de Detenção; um segundo de formação de aliança ampla de direita no contexto do que chamamos de maré cinza, a partir da repercussão do terceiro Programa Nacional de Direitos Humanos (PNDH 3), lançado em dezembro de 2009. A democratização ensejou o início de uma tendência virtuosa de debates e de florescimento de movimentos, organizações e redes da sociedade civil e de avanços no aparato institucional, mas esbarrou em determinados entraves e não logrou mitigar um padrão histórico de violências no país. A popularização da internet e a difusão das redes sociais e das mídias digitais e o fortalecimento da reação à maré rosa agravaram tensões na esfera pública. Neste contexto, a repercussão negativa em relação ao PNDH 3 permitiu uma primeira união ampla no campo da direita contra uma agenda política de direitos humanos em décadas, numa insurgência na esfera pública capaz de imprimir improvável derrota da esquerda, dado que o momento era de bonança econômica e de alta popularidade do Governo. Tal aliança fortificou-se como reação à Comissão Nacional da Verdade, o principal produto do PNDH 3 que vigorou de 2012 até o fim de 2014, quando novas lideranças e retóricas ganharam protagonismo no Brasil. Tal momento de inflexão na esfera pública ampliou entraves e arrastou as narrativas de direitos humanos para o campo das disputas político-ideológicas em um ambiente polarizado. A estrutura da esfera pública foi abalada, emergiram novos atores (individuais e coletivos) e novas formas de ativismo, impactando crenças, repertórios e novas formas de ação. O estudo parte do caso de São Paulo para entender um fenômeno nacional. O esforço metodológico em equilibrar as dimensões de estrutura e agente, de macro e micro, e de considerar as interações múltiplas nos níveis individual e organizacional permitiu identificar inovações nas formas e conteúdos desses conflitos.

The period between the Carandiru Massacre in 1992 and the Antiterrorism Law in 2016 registers two antagonistic movements through which the public sphere related to human rights disputes in the punitive system has passed: a first one of democratization, since the repercussion of the episode in the Casa de Detenção, and a second of what we call the "gray tide", from the repercussion of the third National Program of Human Rights (PNDH 3), launched in December 2009. Democratization caused the beginning of a trend virtuous of debates and flourishing of movements, organizations and networks of civil society and of advances in the institutional apparatus, but ran into certain vetoes and failed to mitigate a historical pattern of violence. The popularization of the internet and the diffusion of social networks and digital media and the strengthening of the reaction to the pink tide have aggravated the tensions in the public sphere. In this context, the negative repercussion in relation to the PNDH 3 allowed a first wide union in the field of the right against a political agenda in decades, in an insurgency in the public sphere able to impress an unlikely defeat of the left, since the moment was of economic boom and high popularity of the Government. Such an alliance was fortified as a reaction to the National Truth Commission, the main product of the PNDH 3, that lasted from 2012 until the end of 2014, when new leaders and speeches came to prevail in Brazil. Such a moment of inflection in the public sphere widened vetoes and dragged human rights narratives into the field of political-ideological disputes in a polarized environment. The structure of the public sphere was shaken, new actors (individual and collective) and new forms of activism emerged, impacting beliefs, repertories and forms of action. The study starts from the case of São Paulo to understand a national phenomenon. The methodological effort in equilibrating the dimensions of structure and agent, macro and micro, and considering the multiple interactions at the individual and organizational levels allowed to identify innovations in the forms and contents of these conflicts.
