O presente estudo pretende analisar, através da revisão literária, as normas que regulamentam a utilização de seres humanos e de animais no ensino e na pesquisa clínica, fazendo um breve histórico dos documentos internacionais e documentos nacionais até o momento atual. Bem como apresentar, de maneira comparativa, as principais diferenças da norma vigente que regulamenta a pesquisa clínica que envolve seres humanos, Resolução 466/12 e a Lei 11.794/2008 que normatiza o uso dos animais no ensino e na pesquisa em nosso país. Importante mencionar que esse trabalho foi motivado pela observação de que há um enorme hiato no "status" jurídico entre as normas que regem a pesquisa envolvendo seres humanos e a Lei que normatiza o uso de animais no ensino e na Pesquisa. Dessa forma, a Resolução do Conselho Nacional de Saúde, 466/12, por ser uma norma infrajurídica, não tem força de Lei, ao passo que a Lei 11.794/2008, Lei Arouca é uma Lei de âmbito Federal e, portanto, prevê sanções no caso de seu descumprimento. Assim, será questionado a pertinência da criação de uma lei que regulamente a pesquisa que envolve seres humanos no Brasil, para que possa haver a devida punibilidade aos casos antiéticos nas pesquisas clínicas no Brasil

This is study seeks to analyze, through literary review, the norms that regulate the use of humans and animals in teaching and clinical researching, making a brief history of the international and national documents up to the present moment. As well as presenting, in a comparative way, the main differences between the current norm that regulates the clinical research involves human beings, Resolution 466/12, and the one using animals in teaching and research, Law 11.794/2008 (Brazilian legislation). It is important to mention that this work was motivated by the observation that there is a huge gap in the legal status between the norms that rules research involving human beings and the law that regulates the use of animals in teaching and researching. Thus, the resolution of the National Health Councils 466/12, as an infra-legal rule, does not have the force of a law, meanwhile, 11.794/2008 - Arouca Law has the force of a federal law, and because of that, it provides penalties in the event of its non-compliance. Then, the pertinence of the creation of a law regulating research involving human beings in Brazil will be questioned, so there may be due punishment for unethical cases in clinical research
