Os altos índices de letalidade da ação policial no país, divulgados por secretarias de segurança pública, denunciados por organizações de defesa dos direitos humanos, noticiados pela imprensa e questionados por organismos internacionais, ainda hoje persistem e resistem como ferida no processo de construção de um Estado Democrático de Direito brasileiro. Diante da impunidade e do crescente número de vítimas - apesar das críticas, recomendações e alternativas existentes para fazer frente ao problema -, o presente estudo objetivou identificar determinantes inconscientes que contribuem para a perpetuação e intensificação dessa violência. Partindo da análise do processamento das mortes pelo Sistema de Justiça Criminal, o estudo inaugura ainda metodologia própria que coloca a escuta psicanalítica, mesmo fora de seu quadro de referência original, em favor da investigação do fenômeno. Tendo como enquadre um processo judicial real em que policiais acusados pelo crime de homicídio no exercício de sua função foram absolvidos pelo Tribunal de Justiça, a escuta de atores do Sistema de Justiça cuja posição restou vencida nesse processo, suas associações e perspectivas, é interpretada, não apenas à luz de referenciais teóricos da metapsicologia psicanalítica, mas também de trabalhos da teoria social de Norbert Elias e de autores dedicados ao estudo da polícia, da violência ou do Sistema de Justiça Criminal. Paradoxalmente, o que se destaca nessa escuta é um silêncio, fio condutor da análise e que sintetiza a ausência de efeitos que a morte da vítima teve sobre o sistema e sobre os sujeitos que o compõem. Os determinantes inconscientes da letalidade policial poderiam então ser identificados em quatro frentes: nas condições normativas, organizacionais e institucionais que garantem a articulação entre impunidade e legalidade; nos aspectos ideológicos e históricos da construção do "processo civilizador" brasileiro; nos processos sociais e subjetivos de legitimação da violência; e, por fim, em um inconsciente jurídico, a partir do qual o processo judicial emerge como sintoma de um trauma coletivo que o extrapola e para o qual ele será sempre insuficiente. Conclui-se que os processos de perpetuação e promoção da letalidade de Estado estão intrinsecamente relacionados a processos comuns da formação do sujeito na sociedade brasileira. O caráter traumático dessa violência não representada, faz com que nas estruturas de nossas instituições e na mais íntima construção de nossas subjetividades, residam não só núcleos de resistência à mudança da política de Segurança Pública, mas também as forças garantidoras da banalização do homicídio na sociedade brasileira e de suas práticas de extermínio

The high rates of the use of deadly force in police action in Brazil (released by public security departments, denounced by human rights organizations, reported by the press, questioned by international bodies and studies by researchers from different disciplines, approaches and institutional affiliations) still persist and resist as a wound to the process of building a brazilian Democratic State of Law. In face of impunity and the growing number of victims, despite numerous criticisms, recommendations and alternatives available to address the problem, this research aimed to identify unconscious determinants that contribute to the perpetuation and intensification of this violence. Based on the analysis of the processing of these deaths by the Criminal Justice System, this dissertation also inaugurates its own methodology that places the psychoanalytical listening, though outside its original frame of reference, in favor of research of this social phenomenon. Having as a background a real lawsuit in which police officers accused of murder in the exercise of their function were acquitted by the Court of Appeals, the hearing of actors of the Justice System whose position was overturned in this lawsuit (their associations and perspectives) is interpreted in light of psychoanalytic metapsychology, Norbert Elias's sociological theory and researches of police, violence or the Criminal Justice System. Paradoxically, what stands out in this listening is silence, a common thread of the analysis which synthesizes the absence of effects that the death of the victim had on the system and on the subjects that compose it. Thus, the unconscious determinants of police lethality could be identified on four fronts: under normative, organizational and institutional conditions that ensure the link between impunity and legality; in the ideological and historical aspects of the Brazilian "civilizing process"; in the social and subjective processes of legitimizing violence; and finally, in a juridical unconscious, from which the lawsuit emerges as a symptom of a collective trauma that overcomes it and for which it will always be insufficient. It is concluded that the processes of perpetuation and promotion of state lethality are intrinsically related with common processes of subject formation in Brazilian society. The traumatic nature of this unrepresented violence causes (in the structures of our institutions and in the most intimate construction of our subjectivities) is not only the resistance to change in Public Security policy, but also the forces that ensure the banality of homicide in Brazilian society and their extermination practices
