A presente pesquisa tem como objetivo geral discutir o diálogo interdisciplinar entre Saúde Mental e Direito como hipótese de abordagem estatal em relação ao comportamento ofensivo grave de adolescentes habituados ao consumo de álcool. Os objetivos específicos são: a) verificar a existência ou inexistência de associação entre o uso de álcool e a gravidade do ato infracional praticado pelo participante; b) verificar se existe ou inexiste associação entre uso de álcool dos adolescentes ofensores e o de seus pais; aprofundar a análise do uso de álcool, para compreender pontos que possam contribuir na percepção dos hábitos alcoólicos do participante. Por ser uma pesquisa de cunho interdisciplinar, optou-se por uma abertura experimental a uma abordagem metodológica alternativa prática, sempre em diálogo com a base metodológica científica clássica, devendo ser entendida a metodologia clássica, aqui, como aquela em que o participante aparece como elemento passivo da pesquisa. A prática, no que se refere ao contexto desta pesquisa, se resume à observação do fenômeno da delinquência juvenil no cotidiano, sob o olhar crítico do jurista que segue carreira acadêmica interdisciplinar. Como recurso de estudo interdisciplinar, foi utilizada a técnica de "epochè metódico" proposta por De Wachter (1982). Os dados coletados referem-se a 480 participantes na cidade de Ribeirão Preto, registrados por ato infracional, sendo 458 participantes do sexo masculino e 22 participantes do sexo feminino. A coleta de dados foi realizada por meio de instrumento de coleta de dados elaborado pelo pesquisador e do questionário do Alcohol Use Disorders Identification Test-AUDIT. Os resultados demonstram que os pais influenciam os filhos no consumo frequente de álcool, e os amigos e parceiros amorosos influenciam no consumo de álcool em geral. Além disso, atos infracionais mais graves estão associados ao uso mais intenso de álcool. Com os dados adicionais sobre hábitos de álcool, verificamos que os participantes parecem ter preferências bem definidas e um consumo socializado, tanto em relação aos locais de consumo, quanto em relação às companhias. Existem, inclusive, tipos de bebidas relatadas como preferidas com maior frequência. Outros dados mostram que os adolescentes encontram-se, em grande proporção, em contato com situações ou comportamentos indicativos de maturidade (atividade sexual com parceiro fixo, relação conjugal, filhos, evasão escolar, direção de veículo automotor, comprar a própria bebida). Um dado que parece destoar desse quadro é alta proporção de participantes que não trabalham. No entanto, com a infração mais frequente é a de tráfico, talvez essa seja a fonte "laborativa" de dinheiro para parte dos participantes. Da análise dos resultados à luz da teoria, bem como da análise legislativa do sistema de justiça juvenil brasileiro, do exercício de "epochè metódico" e da reflexão sobre a interdisciplinaridade entre Direito e Saúde Mental, concluímos que a Saúde Mental pode ser apresentar como uma alternativa de abordagem estatal do adolescente ofensor usuário de álcool, direcionando a prática, operacionalizada pela enfermagem psiquiátrica, de ver o adolescente enquanto um indivíduo na sua integralidade, inaugurando uma nova perspectiva conceitual no sentido de inserir a bioética no plano de discussão jurídica a respeito da delinquência juvenil

This research has the general objective to discuss the interdisciplinary dialogue between Mental Health and Law as an hypothesized statal approach to serious offensive behavior of juveniles who use alcohol. The specific objectives are: a) verify the existence or non- existence of an association between alcohol use and the seriousness of the offense committed by the participant; b) verify whether or not an association exists between alcohol use of adolescents offenders and the alcohol use of their parents; c) deepen the analysis of the use of alcohol, to understand points that may contribute to the perception of the participant's drinking habits. Having this research an interdisciplinary nature, we opted for an experimental contact to a methodological practical alternative approach, always in dialogue with the classical scientific methodological basis, that being understood here as one in which the participant appears as a passive element of the research. The practice with regard to the context of this research comes down to the observation of juvenile delinquency phenomenon in everyday life, under the critical eye of the jurist following an interdisciplinary academic career. As an interdisciplinary study resource, we used the technique of "methodical epochè" proposed by De Wachter (1982). The data collected refer to 480 participants in the city of Ribeirão Preto, registered for offenses, being 458 male participants and 22 female participants. Data collection was conducted through data collection instrument developed by the researcher and the Alcohol Use Disorders Identification Test-AUDIT. From the results, we realize that parents influence their children in frequent alcohol consumption, and peers and boyfriend/girlfriend influence on alcohol consumption in general. In addition, more serious offenses are associated with increased use of alcohol. With additional data about alcohol habits, we noticed that the participants seem to have well-defined preferences and a socialized consumption, both in relation to the local of consumption, and to the companionships. In addition, there are kinds of beverages reported as more often preferred. Other data show that juveniles are to a great extent in contact with situations or behaviors indicative of maturity (sexual activity with a steady partner, marital relationship, children, truancy, driving, buying their own alcoholic beverage). A fact that seems to clash with this situation is the high proportion of participants who are not working. However, with the most common offense being drug trafficking, maybe that's the source of money to the participants. Analyzing the results in light of the theory as well as the legislative analysis of the Brazilian juvenile justice system, the exercise of "methodical epochè" and reflection on the interdisciplinarity between Law and Mental Health, we have concluded that Mental Health may be presented as an alternative statal approach to juvenile offender who uses alcohol, driving the practice, operationalized by psychiatric nursing, to see the adolescent as an individual in its integrality, ushering a new conceptual perspective in order to insert bioethics in the legal discussion regarding juvenile delinquency
