O presente trabalho busca apontar e debater os entraves do sistema jurídico brasileiro para a efetivação dos direitos humanos de crianças e adolescentes vítimas de violência sexual. Para tanto, apresenta um estudo de caso realizado com Núcleo de Atendimento às Vítimas de Crimes Violentos (NAVCV-BH), de onde foram extraídos e analisados cinco entraves principais: a dicotomia entre o tempo da vítima e o tempo do direito; a participação das vítimas nos processos judiciais como um direito que pode assumir contornos de dever; as dificuldades da análise do discurso de crianças e adolescentes vítimas de violência sexual; a divisão dos interesses e direitos das vítimas em mais de um processo de natureza distinta; e o segredo de justiça como elemento protetivo e prejudicial às vítimas em relação à integração dos parceiros institucionais da rede de proteção. A análise é construída a partir da literatura nacional e internacional existente sobre o tema, bem como a partir de entrevistas pontuais realizadas e, principalmente, através de apresentação e análise aprofundada, global e interligada das normativas nacionais e internacionais aplicáveis.

Abstract in English
This paper seeks to identify and discuss the barriers of the Brazilian legal system for the realization of human rights of children and adolescents victims of sexual violence. It presents a case study conducted with Núcleo de Atendimento a Vítimas de Crimes Violentos (NAVCV- BH), from which were extracted and analyzed five main barriers: the dichotomy between the time of the victim and the time for the law; the participation of victims in court proceedings as a right that can take contours of duty; the difficulties of discourse analysis of children and adolescents victims of sexual violence; the division of the interests and rights of victims in more than one process of a different nature; and the secrecy of justice as protective and detrimental element to the victims in the integration of the institutional partners of the protection network. The analysis is built upon the existing national and international literature, as well as from individual interviews and mainly through presentation and deep interconnected analysis of national and international standards applicable.
