A escassez de especificidade do garantismo constitucional para tutelar o processo administrativo é latente em nosso ordenamento jurídico quando comparada as outorgadas ao processo judicial. A construção da processualidade administrativa advém das Revoluções Sociais ocorridas na Europa, ainda em meados do Século XVIII, na busca constante da sociedade pelo reconhecimento de direitos coletivos e garantias individuais em proteção à diversas práticas abusivas da Administração Pública. No Brasil, o processo administrativo ganhou roupagem constitucional com o advento da Emenda Constitucional nº 19, que ao inserir o art. 37, assegurou ao administrado a participação no deslinde do processo administrativo, reflexo da ideia do contraditório e da ampla defesa amplamente difundidas no processo judicial. O estudo do direito comparado exerce papel fundamental na evolução do nosso processo administrativo, mormente existir nações, a exemplo da Alemanha, onde sistema administrativo adotado permite a existência de Tribunais Administrativos próprios. O próprio regramento federal estatuído com o objetivo de regular o processo administrativo no âmbito da Administração Pública Federal, excepciona sua aplicação aos processos administrativos específicos, evidenciando ainda mais a falta de homogeneidade do processo administrativo brasileiro e a necessidade de revisão dos atos pelo Poder Judiciário. É nesse sentir o desenvolvimento da dissertação para demonstrar a carência de aplicabilidade das garantias constitucionais às diversas espécies de procedimentos administrativos em que pese à simetria constitucional outorgada ao processo judicial ao processo administrativo.

The lack of specificity of constitutional guarantees in order to protect the administrative process is latent in our legal framework when compared to those granted to judicial process. The construction of administrative proceeding has its origin in the Social Revolutions, which took place in Europe in the early XVIII century, by society constant search for recognition of collective rights and individual guarantees menaced by abusive public administration practices. In Brazil, administrative process gained new constitutional outfit with Constitutional Amendment n. 19, which included article 37, ensuring the administrated participation in the result of the administrative process, adding by reflex the concepts of right to contradictions and full defense largely spread in judicial process. Comparative law studies have had a fundamental role in the development of our administrative process, especially because there are nations, such as Germany, where the administrative system allows for the existence of Administrative Courts. The very federal laws created to regulate the administrative process at the Federal Public Administration level, do not allow the application of such rules to specific administrative process, which highlights the lack of homogeneity in the Brazilian administrative process and the need of revision of such acts by the Judiciary. The present work aims at demonstrating the deficiency in the applicability of the constitutional guarantees to the many types of administrative processes, regardless of the constitutional symmetry granted to judicial process and administrative process.
