Desde a Segunda Guerra Mundial, a jurisdição constitucional experimenta um contínuo avanço e fortalecimento ao redor do mundo. Isso levou incontinenti à elaboração de diversas teorias sobre a superação dos tradicionais modelos norte-americano e europeu de controle de constitucionalidade das leis. O objeto do presente exame é, especificamente, a análise das estruturas (históricas, funcionais e sistêmicas) e dos aspectos processuais dos modelos tradicionais, de modo a testar a seguinte hipótese: apesar de algumas semelhanças entre aspectos processuais, as diferentes estruturas político-funcionais dos modelos norte americano e europeu ainda são razões para a distinção entre eles e implicam concepções diversas quanto à organização estatal. O primeiro capítulo analisa os movimentos político constitucionais das democracias liberais ocidentais inglesa, americana, francesa e europeia (genericamente), desde o constitucionalismo moderno até a atual conformação de seus sistemas de controle de constitucionalidade da legislação. O segundo capítulo considera a evolução dos aspectos processuais dos modelos norte-americano e europeu de controle de constitucionalidade das leis. O terceiro e último capítulo analisa a estrutura político funcional de cada um no que se refere à estrutura funcional modo como é organizado o exercício da função jurisdicional, em especial, a jurisdição constitucional e à estrutura sistêmica tradição (ou família) jurídica na qual foi gestado cada modelo. O objetivo é examinar os influxos exercidos por cada uma dessas estruturas sobre os modelos norte americano e europeu de controle, bem como as discussões que sobre elas se apresentam. A conclusão é que, se subsistem as razões estruturais que levaram a opções distintas quanto à separação ou não das jurisdições constitucional e ordinária, a mera aproximação de alguns aspectos processuais que, no mais das vezes, sequer são tão rígidos, servindo mais a propósitos classificatórios não é suficiente para superar a distinção entre o modelo europeu e o modelo norte-americano de controle de constitucionalidade das leis.

Since World War II, the constitutional jurisdiction experiences continuous development and empowerment around the world. This lead incontinenti to the development of various theories about overcoming traditional North American and European models of control on judicial review. The object of this study is, specifically, the analysis of structures (historical, functional and systemic) and the procedural aspects of traditional models in order to test the following hypothesis: in spite of some similarities on procedural aspects, the differences between functional and political structures of North American and European models are still reason for their distinction and imply different conceptions about the state organization. The first chapter analyzes the political and constitutional movements of English, American, French and European (in general) Western liberal democracies from the modern constitutionalism to the present conformation of its constitutionality control systems. The second chapter analyses the evolution of the procedural aspects of North American and European models of judicial review. The third and final chapter analyzes the political and functional structure of each model in regard to the functional structure how the exercise of jurisdictional function is organized, especially the constitutional jurisdiction and the systemic structure legal tradition (or family) in which each model was brought. The objective is to examine the inflows exercised by each of these structures on the North American and European control models as well as the discussions surrounding them. The conclusion is that, if there are still structural reasons that lead to the different options in regard to the separation of the constitutional and ordinary jurisdictions, the mere proximity of some procedural aspects which, in most cases, are not even as rigid, serving basically to classification purposes is not enough to overcome the distinction between the European model and the US model of judicial review.
