A presente dissertação analisa as relações entre federalismo e políticas sociais na Constituição de 1988. Para tanto, aborda os conceitos de federalismo e de Estado federal, suas principais características, bem como sua origem e evolução no mundo e no Brasil. Realiza também uma análise do modelo brasileiro de repartição de competências adotado pela Constituição de 1988 com relação à formulação e execução de políticas públicas na área social, notadamente nos direitos à saúde, educação, habitação, saneamento e assistência social. Traz ainda alguns ensaios complementares sobre o tema, tratando dos consórcios públicos, do controle e intervenção do Poder Judiciário na formulação e execução das políticas públicas e de como outras federações (Estados Unidos, Canadá e Alemanha) lidam com o tema. Com base nestes elementos, conclui-se que o Brasil está promovendo um lento, porém consistente, avanço sob o ponto de vista federativo, e que, a despeito de todos os problemas já experimentados ou que ainda serão vividos ao longo deste processo, as reformas promovidas nas duas últimas décadas, que alteraram sensivelmente as relações intergovernamentais para a formulação e execução das políticas sociais previstas na Constituição de 1988, indicam que o federalismo brasileiro está caminhando na direção correta na questão das políticas públicas para garantia dos direitos sociais por ela consagrados.

The dissertation hereby has the scope of analyzing the relations between federalism and social policies stated in the 1988 Constitution. For such, it approaches the concepts of federalism and federal state, their main characteristics, as well as their origins and evolution worldwide and in Brazil. It also analyses the Brazilian model of sharing competences adopted by the 1988 Constitution regarding creating and executing social public policies, especially the ones related to the right of health, education, housing, sanitation and social assistance. It also brings some complementary essays about the theme regarding public joint ventures, the Judiciary control and intervention in the creation and execution of public policies and how other federations (USA, Canada and Germany) deal with the subject. Based on those elements, the conclusion is that Brazil is developing a slow but consistent improvement on the federative point of view and that, in spite of every issue that already happened or not, the changes that had happened in the last two decades, which sensibly modifi ed the intergovernmental relations for doing and executing public policies predicted in the 1988 Constitution, indicates that the Brazilian federalism is on the right track of doing public policies in order to grant the social rights foreseen on its current Constitution.
