A presente dissertação tem por finalidade analisar o modelo jurídico da regulação descentralizada, identificando os conflitos jurídicos que surgem entre os entes envolvidos. Para que o objetivo seja alcançado o estudo abrange os setores de energia elétrica e gás natural, tendo em vista que no primeiro houve a delegação de algumas atividades da agência reguladora federal para os Estados membros e no segundo convivem campos de competência regulatória federal e estadual. A pesquisa será iniciada por meio de uma abordagem de aspectos relevantes sobre a regulação dos setores de infraestrutura e serviços conexos com o intuito de demonstrar as questões que envolvem a regulação descentralizada. Em seguida será apresentado um panorama geral do federalismo brasileiro. Após a apresentação dos pontos mencionados acima, será realizada uma análise específica de cada setor objeto do estudo, demonstrando as características específicas e as razões para a regulação ser realizada de forma descentralizada. Por fim, serão apontados os conflitos que surgem nesse modelo, com base na doutrina e na jurisprudência.

This dissertation aims to analyze the legal model of the decentralized regulation, identifying legal conflicts that arise from the relationship of the entities related thereto. In order to achieve this dissertations purpose, the study will focus on not only the electricity, but in the natural gas industry as well. In the former, there was the delegation of some activities of the federal regulatory agency to the Member States, and in the latter both Federal and State regulatory competences can be found simultaneously. The research will firstly approach the relevant aspects of the regulation of infrastructure services in order to point out the main issues involving the decentralized regulation. Thereafter, an overview of the Brazilian federalism will be presented. After the presentation of the points mentioned above, it will be held a specific analysis regarding the above mentioned industries. Accordingly, some specific features will be presented, as well as the reasons why the regulation is carried out decentralized. Finally, it will be pointed out the conflicts that arise from this model, always taking into consideration the doctrine and jurisprudence related thereto.
