A hemoterapia é uma especialidade médica que tem uma extensa regulamentação técnica no país. O conhecimento e disseminação da legislação aplicada à hemoterapia é essencial para fundamentar o exercício da hemoterapia e promover a adequada execução, controle e fiscalização das atividades do setor. Esse trabalho teve por objetivo realizar o mapeamento do repertório da legislação aplicada à hemoterapia, a partir dos diplomas constitucional, legais e dos demais atos normativos da área do sangue, demonstrando de forma sistematizada a produção da legislação da área. O ordenamento jurídico da hemoterapia em nível federal teve seu início a partir de 1950, porém, apenas em 1965 o poder público estabeleceu os princípios e diretrizes norteadores da Política Nacional de Sangue (PNS). Desde 1940 são identificados 141 atos normativos de interesse da área do sangue, mas foi partir da Lei nº 4.701/1965 que um extenso repertório normativo foi construído para regulamentação das atividades hemoterápicas, gestão nacional da hemoterapia e estruturação da política de sangue, entre outros temas no setor. Após a década de 1980, com a reforma sanitária brasileira e o surgimento de graves epidemias transmissíveis por transfusão, houve o reforço na legislação específica, levando à evolução da PNS. Com a nova Constituição Federal de 1988 foi determinado o fim do comércio de sangue, e o advento do SUS trouxe a reestruturação da hemoterapia brasileira. Nesse contexto, as atividades hemoterápicas passaram a ser executadas no âmbito do Sistema Nacional de Sangue, Componentes e Derivados (SINASAN), regulamentado pela Lei nº 10.201/2001, ao qual coube a implementação de uma nova política nacional de sangue iniciando um novo período normativo para a hemoterapia brasileira. A produção da legislação aplicada à hemoterapia destes períodos foi identificada e classificada para fins registro e formação de um banco de dados que permita o acesso facilitado ao público interessado na hemoterapia.

The blood therapy is a medical specialty that has extensive technical regulations in Brazil. The knowledge and dissemination of the blood-fields legislation is essential to support the exercise of the blood therapies and to promote proper execution, control and sanitary inspection of the activities of the sector. This study is aimed to perform the mapping of the repertoire of the blood-fields legislation from constitutional, legal and other normative acts in the specialty, systematically demonstrating the formulation of legislative parameters of the area. The legal system of blood therapy at federal level had its beginning in 1950; nonetheless, it was only in 1965 that the government established the guiding principles and precepts of the National Blood Policy (PNS, acronym in Portuguese). Since 1940, 141 normative acts of the blood-field have been identified, but it was from the Law No. 4,701/1965 that an extensive regulatory repertoire was built to regulate blood therapy activities, the national management, and the structuring of the blood policies, among other topics in the sector. After the 1980s, along with the Brazilian health reform and the emergence of serious epidemics transmitted by transfusion, the specific legislation was enhanced, leading to the evolution of the PNS. With the new Federal Constitution of 1988, it was determined the end of blood commercialization; and the advent of the National Health System (SUS, acronym in Portuguese) brought the restructuring of the Brazilian blood policy. In this context, the activities of the blood-field became implemented under the National System of Blood and Blood Products (SINASAN, acronym in Portuguese), regulated by the Law No. 10,205/2001, which fell to the implementation of a new national blood policy starting a new regulatory period for the Brazilian blood therapy. The production of the blood normative at these periods was identified and classified for registration purposes and forming a database that allows the public interested in the area with easier access.
