O estudo surge de reflexões e diálogos com grupos formados na Universidade de São Paulo que reivindicam da instituição uma resposta às violências contra as mulheres ocorridas em seus contextos. Essa reivindicação surgiu porque a universidade, ao não enfrentar essa violência, praticou violência institucional contra as mulheres nos termos dos tratados internacionais de direitos humanos das mulheres que o Brasil é signatário. Assim, em contato com esses grupos, o objetivo do trabalho é a propositura de formas institucionais e parâmetros normativo-dogmáticos para o enfrentamento da violência contra as mulheres na universidade, enfatizando a responsabilidade jurídica das instituições de ensino superior no enfrentamento desse problema. Pela centralidade desses grupos na reivindicação normativa, fizemos o acompanhamento do processo de construção de agenda e políticas desses grupos para o enfrentamento da violência contra as mulheres nas universidades brasileiras. Esse enfrentamento existe há mais tempo em outros países, como Estados Unidos, países europeus e latino-americanos. Desta forma, para compreender as características desse tipo de violência e as respostas já delineadas pelas universidades desses países, realizamos uma revisão bibliográfica sobre a violência contra mulheres em contexto universitário. Procuramos também entender a violência contra mulheres sob a perspectiva dos tratados internacionais e da legislação nacional sobre direitos humanos das mulheres. Dentro desta perspectiva, buscamos compreender as dificuldades do enfrentamento institucional da violência contra as mulheres, para evitar essas dificuldades e, incorporando as críticas feitas ao enfrentamento institucional da violência, ser um novo mecanismo de enfrentamento à violência contra as mulheres a fim de promover seus direitos humanos, dentre eles, o direito a viver uma vida livre de violência.

The study emerges from reflections and dialogues with feminist groups formed in the University of São Paulo, which claim a response from the institution to the violence against women occurred in its contexts. This claim arose due to the university´s failure facing these acts of violence, thus practicing institutional violence against women in the terms of international treaties of human rights that Brazil has signed. Therefore, in contact with these groups, the objective of this work is to propose new institutional forms and dogmatic-normative parameters towards the struggle facing violence against women in the university, emphasizing the legal responsibility of superior education institutions to face this problem. Due to the centrality of these groups in claims of normative change, we have followed the process of construction of their agendas and policies towards the struggle facing violence against women in the Brazilian universities. This struggle exists longer in other countries, such as the United States, European and Latin American countries. Thus, in order to comprehend the characteristics of this type of violence and the already delineated answers given by the universities in these countries, we accomplished a bibliographic revision about violence against women in the university´s context. We also sought to understand the violence against women under the perspective of the international treaties and the national legislation about women´s human rights, which, in a critical feminist perspective of Law, claims its rights in the very institutions that have historically denied them. In this perspective, we aimed to comprehend the difficulties of the institutional struggle facing violence against women, to avoid them and, incorporating the critics done to the institutional struggle facing violence, to be a new mechanism of struggle promoting women´s human rights, amongst them, the right to live free from violence.
